Easements

An easement is a right or privilege that one has in land owned by another. It is a right to a limited use in another's land for some specific purpose. Typical easements include rights of way for access, extension of utilities and water rights. There are many other types of easements as well. Land that is benefited by a certain easement is referred to as the "dominant" tenement. Land that is burdened by an easement is called the "servient" tenement.

Private Covenants

A Private covenant is a written agreement between two or more parties to do or not to do some specific act. A covenant is a binding agreement that "runs with the land". When a covenant is broken the remedy is an action for damages against the person who made the promise. Private covenants are typical in subdivided properties.
